{"id":518,"date":"2024-10-25T14:31:48","date_gmt":"2024-10-25T14:31:48","guid":{"rendered":"https:\/\/radiogzplus.com\/?p=518"},"modified":"2024-10-25T14:31:52","modified_gmt":"2024-10-25T14:31:52","slug":"corte-constitucional-fallo-a-favor-de-policias-municipales-en-accion-de-proteccion","status":"publish","type":"post","link":"https:\/\/radiogzplus.com\/index.php\/2024\/10\/25\/corte-constitucional-fallo-a-favor-de-policias-municipales-en-accion-de-proteccion\/","title":{"rendered":"Corte Constitucional fall\u00f3 a favor de polic\u00edas municipales en acci\u00f3n de protecci\u00f3n"},"content":{"rendered":"\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-full\"><img fetchpriority=\"high\" decoding=\"async\" width=\"768\" height=\"384\" data-id=\"521\" src=\"https:\/\/radiogzplus.com\/wp-content\/uploads\/2024\/10\/municipales-2.webp\" alt=\"\" class=\"wp-image-521\" srcset=\"https:\/\/radiogzplus.com\/wp-content\/uploads\/2024\/10\/municipales-2.webp 768w, https:\/\/radiogzplus.com\/wp-content\/uploads\/2024\/10\/municipales-2-300x150.webp 300w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/><\/figure>\n<\/figure>\n\n\n\n<p class=\"has-black-color has-luminous-vivid-orange-to-vivid-red-gradient-background has-text-color has-background has-link-color wp-elements-d8ae6365d2fb1117f166db76717073a0\"><strong>Una acci\u00f3n de protecci\u00f3n presentada por el Cuerpo de Agentes de Control Municipal consigui\u00f3 el fallo a favor \u2014en la Corte Constitucional\u2014, y da 2 meses al Municipio de Loja para elaborar el org\u00e1nico estructural y pueda darse el ascenso y homologaci\u00f3n salarial.<\/strong><\/p>\n\n\n\n<p><strong>Circunstancias<\/strong><\/p>\n\n\n\n<p>El abogado Juan Carlos Castillo refiri\u00f3 que, el mi\u00e9rcoles 23 de octubre de 2024, recibieron la notificaci\u00f3n, donde \u2014por unanimidad\u2014 la Corte Constitucional fall\u00f3 a favor de los agentes declarando el incumplimiento del Municipio de Loja, respecto a la Ordenanza 028-2021, que regula en funcionamiento y la estructura del Cuerpo de Agentes de Control Municipal.<\/p>\n\n\n\n<p>\u201cDispone a la Municipalidad que en el termino de 2 meses proceda a elaborar los reglamentos para el org\u00e1nico estructural; y, Talento Humano forme las evaluaciones correspondientes para el ascenso y homologaci\u00f3n salarial al que tienen derecho los polic\u00edas municipales\u201d, refiri\u00f3.<\/p>\n\n\n\n<p>Todas las disposiciones deben cumplirse, caso contrario los representantes de los departamentos municipales incurrir\u00e1n en sanciones: directores estrat\u00e9gicos, jefes operativos, jefe de Talento Humano y alcalde, como autoridad nominadora.<\/p>\n\n\n\n<p>\u201cSobre las resoluciones que est\u00e1n en el fallo, el Ayuntamiento local ya no pueden plantear recurso alguno, sea vertical o horizontal, toda vez que la Corte Constitucional es una entidad de cierre y no se pueden dilatar m\u00e1s los casos\u201d, puntualiz\u00f3.<\/p>\n\n\n\n<p>El jurista mencion\u00f3 que los agentes municipales todav\u00eda siguen siendo manejados con nominaciones obsoletas, por ejemplo, cabos, sargentos\u2026 cuando el C\u00f3digo Org\u00e1nico de Entidades de Seguridad Ciudadana y Orden P\u00fablico (Coescop) establece grados desde el primero al cuarto, con lo que podr\u00edan percibir un mayor salario; es decir, lo que actualmente ganan igual todos (alrededor de USD 585), subir\u00eda de USD 773 hacia arriba dependiendo del grado.<\/p>\n\n\n\n<p>Diario Cr\u00f3nica acudi\u00f3 a la Municipalidad para conocer el accionar a ejecutar tras el fallo de la CJ a favor de los agentes municipales; pero, hasta el cierre de la edici\u00f3n, no hubo respuesta.
